Welcome to Operation WarriorFit. By accessing our website or using our services, you agree to be bound by these Terms of Service. Please read them carefully.

1. ACCEPTANCE OF TERMS

By accessing operationwarriorfit.com or participating in any Operation WarriorFit programs, you agree to these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services.

2. ELIGIBILITY

Our race entry program is available to eligible individuals who fall into one of the following categories:

  • U.S. Military Veterans (honorably discharged)
  • Active Duty Service Members
  • Reservists and National Guard Members
  • First Responders (firefighters, law enforcement, EMTs, paramedics, nurses, corrections officers)

By applying for our program, you certify that you meet the eligibility requirements. Falsifying eligibility information may result in removal from the program and disqualification from future participation.

3. PROGRAM PARTICIPATION

Race Entry Allocation

Race entries are provided on a first-come, first-served basis and are subject to availability. Receiving a race entry is not guaranteed. OWF reserves the right to allocate entries based on availability, geographic location, and program needs.

Participant Responsibilities

When you receive a race entry through OWF, you agree to:

  • Complete the check-in process before each event
  • Participate in and complete the race to the best of your ability
  • Report back after the event as requested
  • Represent OWF in a positive and respectful manner
  • Not transfer, sell, or give away your race entry to another person

No-Shows and Cancellations

If you cannot attend a race for which you have received an entry, you must notify OWF as soon as possible. Repeated no-shows without notice may result in reduced priority for future race entries or removal from the program.

4. ASSUMPTION OF RISK

Participation in athletic events involves inherent risks, including but not limited to physical injury, illness, or death. By participating in races through OWF, you acknowledge and voluntarily assume all risks associated with such participation.

You understand that you are responsible for your own physical fitness and health. We recommend consulting with a healthcare provider before participating in any athletic events.

5. RELEASE AND WAIVER

By participating in OWF programs, you release, waive, and discharge Operation WarriorFit, its officers, directors, employees, volunteers, and partners from any and all liability for any injury, illness, or loss arising from your participation in events.

6. DONATIONS

All donations to Operation WarriorFit are voluntary and non-refundable. OWF is a 501(c)(3) nonprofit organization, and donations may be tax-deductible to the extent permitted by law. Consult your tax advisor for specific guidance.

Donation allocations shown on our website are general guidelines and may vary based on organizational needs. OWF reserves the right to allocate funds in the manner it deems most beneficial to fulfilling its mission.

7. INTELLECTUAL PROPERTY

All content on this website, including text, graphics, logos, images, and software, is the property of Operation WarriorFit and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.

8. MEDIA RELEASE

By participating in OWF events or submitting photos/testimonials, you grant OWF permission to use your name, likeness, and story for promotional purposes, including social media, website content, and marketing materials. If you prefer not to be featured, please notify us in writing.

9. CODE OF CONDUCT

All participants are expected to:

  • Treat all individuals with respect and dignity
  • Refrain from harassment, discrimination, or abusive behavior
  • Follow all race rules and regulations
  • Represent the veteran and first responder community positively

Violation of this code of conduct may result in removal from the program.

10. DISCLAIMER OF WARRANTIES

This website and our services are provided "as is" without warranties of any kind, either express or implied. OWF does not warrant that the website will be uninterrupted, error-free, or secure.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Operation WarriorFit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or participation in events.

12. MODIFICATIONS

OWF reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the website. Your continued use of our services after any modifications constitutes acceptance of the updated terms.

13. GOVERNING LAW

These Terms of Service shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.
